USCIS Recommended New Ways for Laid-off H1B to Stay in the US

As mass layoffs are happening and many H1B employees are losing their jobs. USCIS answered the question of looking for a new job while in B-1 or B-2 status. USCIS was mentioned in the tweet. “The answer is yes. Searching for employment and interviewing for a position are permissible B-1 or B-2 activities.”

The USCIS director, Ur M Jaddou, has written a letter to the Foundation of India and Indian Diaspora Studies stating, “When non-immigrant workers are laid off, they may not be aware of their ways and may, in some instances.”

(FIIDS) has been working for jobless H-1B visa holders and addressed the impacts of layoffs in the technology sector, which bought an increase of grace period upto 60-day, according to the news agency PTI.

The letter also says the USCIS acknowledges the financial and emotional impact on employment-based non-immigrant workers and their families in the United States with the termination.

The fired H-1B staffers can be the beneficiary of a nonfrivolous petition to change employer and also apply for a ‘compelling circumstances’ employment authorization document. In addition, US District Judge Tanya Chutkan has granted employment authorization cards to spouses of certain categories of H-1B visa holders.
